Terms & Conditions

 

1. Quotations

All quotations are provided based on the information supplied by the customer at the time of quoting.

Any variations to the work before commencement will result in a revised quotation being issued for acceptance.

Variations after work has commenced will be subject to a fixed price agreed between Factory Fit Screens (FFS) and the customer, which will be added to the final invoice.

If requirements change due to insufficient information provided by the customer, or defects found in existing installations, the customer will be liable for any additional expense incurred.

Quotations remain valid for 2 months from the date of issue. Work must commence within 3 months of the quotation date, otherwise a new quotation will be required.

The customer is liable for the cost of any additional work, services, or fittings required to rectify unexpected events or circumstances outside FFS’s control.

2. Orders & Part Payment

Acceptance of a quotation constitutes acceptance of these Terms & Conditions.

A 50% part payment of the total invoice amount is required before any production begins.

Screens will not go into production until the part payment has been received in cleared funds.

The remaining 50% balance is payable within 7 days of completion of installation.

3. Payment Terms

Final balance must be paid within 7 days after completion of the works.

Any fees associated with debt recovery (including debt collection agency costs, solicitor fees, or court costs) will be added to your account and are payable by you.

4. Retention of Title

All Goods remain the property of Factory Fit Screens until full payment (including any fees or charges) has been received.

If payment is not made, FFS reserves the right to enter the premises and remove the Goods without liability for damage caused during removal.

Risk in the Goods passes to the customer upon delivery or installation, even if title has not yet transferred.

5. Delivery & Installation

Any dates provided for delivery or installation are estimates only and may be subject to change.

Customers must ensure clear and safe access to the site. Delays caused by access issues may result in additional charges.

Upon completion of installation, the customer must inspect the Goods. Any issues must be reported within 7 days.

6. Warranty

Goods supplied by FFS include warranties as required by the Australian Consumer Law (ACL).

Warranty claims must be made in writing, with proof of purchase provided.

Warranty does not cover damage caused by misuse, neglect, accidents, or failure to maintain the products.

7. Liability

To the maximum extent permitted by law, FFS will not be liable for indirect, incidental, or consequential loss or damage.

Liability is limited to, at FFS’s discretion: repairing or replacing the Goods, or refunding the cost of the Goods/services.

8. Cancellation

Orders cancelled after acceptance may incur charges for work already completed, materials ordered, or administrative costs.
Deposits are non-refundable unless otherwise required by law.

9. Debt Collection

Overdue accounts may be referred to a debt collection agency or legal representative.

All associated recovery costs will be added to your account balance.

10. Governing Law

These Terms & Conditions are governed by the laws of Queensland, Australia.

Any disputes will be resolved under the jurisdiction of Queensland courts.
